DECISION

APPROVAL OF PLANNING FOR CONSTRUCTION OF WORKING OFFICES OF MINISTRIES, MINISTERIAL AGENCIES, GOVERNMENTAL AGENCIES AND CENTRAL GOVERNMENT AUTHORITIES OF ASSOCIATIONS IN HA NOI CAPITAL BY 2030

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated December 25, 2001;

Pursuant to the Law on Construction dated November 26, 2003;

Pursuant to the Law on Urban Planning dated June 17, 2009;

Pursuant to the Law on Management and Use of State-owned Property dated June 03, 2008;

Pursuant to the Law on Capital dated November 21, 2012;

Pursuant to the Decision No. 1259/QD-TTg dated July 26, 2011 on approval of the construction master planning for Ha Noi Capital by 2030 with a vision by 2050;

At the request of the Minister of Construction;

HEREBY DECIDES:

Article 1. The planning for construction of working offices of Ministries, Ministerial Agencies, Governmental Agencies and central-government authorities of associations in Ha Noi Capital by 2030 is hereby approved with the following primary contents:

1. Planning subjects and location

a) Planning subjects

The planning subjects are working offices of Ministries, Ministerial Agencies, Governmental Agencies and central-government authorities of associations in Ha Noi Capital (hereinafter referred to as “working offices of Ministries and regulatory authorities”). Working offices of public service units and specialized units of Ministries and central-government authorities.

b) Planning location

- The planning for construction of working offices of Ministries and regulatory authorities covers the whole territory of Ha Noi City.

- The detailed planning for construction of a centralized office area of 1/500 scale covers two areas, Tay Ho Tay and Me Tri. Specific boundaries are determined during the planning formulation.

2. Planning objectives

- Establish a comprehensive system of administrative offices that meets using demands and is conformable with development orientations of Ha Noi Capital.

- Establish legal grounds for implementing working office construction projects according to the planning.

3. Requirements for planning contents

a) Review and assessment: Review and assess the actual conditions of working offices of Ministries and regulatory authorities, and determine working offices to be relocated.

b) Formulation of planning for working offices of Ministries and regulatory authorities

- Forecast short-term and long-term development demands; propose planning indicators.

- Do research on solutions for planning for working offices of Ministries and regulatory authorities; and select feasible solutions which must meet using demands, landscape architecture, technical - social infrastructure and environmental protection requirements as well as must be modern and synchronous.

- Formulate planning for technical infrastructure and determine other supporting technical infrastructure requirements.

c) Formulation of a detailed planning of 1/500 scale: The centralized area for working offices of Ministries and regulatory authorities with a scale of 35 ha at Tay Ho Tay central area and with a scale of 30 ha at Me Tri area: Select planning model, propose planning solutions for space and landscape architecture, land use, technical infrastructure facilities, and prepare planning dossiers in accordance with regulations of law, and submit them to competent authorities for approval.

d) Proposal of solutions for implementing the approved planning.

4. Dossier requirements

Planning dossiers must comply with the Government’s Decree No. 08/2005/ND-CP dated January 24, 2005 on construction planning, the Government’s Decree No. 37/2010/ND-CP dated April 07, 2010 on formulation, appraisal, approval and management of urban planning and relevant laws.

5. Implementation organization: 

- Approving authority: The Prime Minister.

- Appraised and submitted for approval by: Ministry of Construction.

- Implementation period: 09 months after the planning is approved.

Article 2. Ministry of Construction shall:

- Play the leading role and cooperate with the Ministry of Finance, Ministry of Home Affairs, the People's Committee of Ha Noi City and relevant agencies in formulating the Planning for construction of working offices of Ministries, Ministerial Agencies, Governmental Agencies and central-government authorities of associations in Ha Noi Capital by 2030, and submitting it to a competent authority for approval.

- Allocate funding and consider approval for general cost estimate for formulating the planning for construction of working offices of ministries, ministerial agencies, governmental agencies and central government authorities of associations in Ha Noi Capital by 2030 and performing relevant activities.

Article 3. This Decision comes into force as from the date on which it is signed.

The Minister of Construction and heads of relevant agencies are responsible for the implementation of this Decision./.
