RESOLUTION

PROMULGATING PROGRAM FOR CUTTING AND SIMPLIFYING BUSINESS REGULATIONS DURING 2020 - 2025

THE GOVERNMENT

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 promulgated Working Regulation of the Government;

At the request of the Minister, Chairman/Chairwoman of the Office of the Government.

HEREBY RESOLVES:

A program for cutting and simplifying business regulations during 2020 – 2025 (hereinafter referred to as “the Program”) is promulgated. To be specific:

1. Treat enterprises and the people as the driving force for national socio-economic development; enable enterprises and the people to participate in business activities; reduce time and costs of compliance by enterprises and the people with business regulations.

2. Immediately cut or simplify unnecessary, unreasonable and illegal regulations specified in applicable documents which obstruct and make trouble for enterprises and the people, thereby contributing to improving the efficiency, accomplishing the objective for state management and boosting enterprise development.

3. Ensure the publicity and transparency; heighten responsibility of heads of state administrative agencies at all levels for reforming business regulations.

4. Adhere to the international agreements, including Free Trade Agreements to which Vietnam is a signatory.

II. OBJECTIVES, REQUIREMENTS AND SCOPE OF EXECUTION

1. Objectives:

a) During 2020 – 2015, cut and simplify at least 20% of the number of regulations and reduce at least 20% of costs of compliance with business regulations set out in effective documents by May 31, 2020, the compliance costs shall be calculated by Ministries and statistics authorities and announced for the first time (by October 31, 2020); minimize the number of applicable documents providing for business regulations within the power of Ministers, heads of ministerial agencies, Prime Minister and Government.

b) Tighten control of promulgation of documents containing business regulations on the basis of legal regulations, especially administrative documents, circulars of Ministers and heads of ministerial agencies, decisions of the Prime Minister, decrees of the Government; prevent the emergence of unnecessary, unreasonable, and illegal regulations which make trouble for business activities of enterprises and the people.

b) Cut and simplify business regulations in such a way that quantifies benefits brought to enterprises, the people and society, does not adversely affect activities, legitimate rights and interests of enterprises and the people; make sure that the state management objective is accomplished and no legal gaps are created in regulations of law.

c) Comply with the regulations set out in Clause 3 Article 11 of the Law on Promulgation of Legislative Documents when promulgating an elaborating document related to business activities in a manner that integrates multiple contents in a document so as to minimize the number of elaborating documents, thereby ensuring the consistency and facilitating the implementation of and compliance with law.

d) Request the competent authority to permit adoption of the following method: amendments to multiple documents are included in one document upon promulgation of a document that amends, supplements or replaces applicable documents related to business activities in order to execute plans to cut and simplify business regulations (except for the documents providing for complex or sensitive issues concerning national security, social order and safety).

3. Scope of execution:

Produce statistics, conduct review, calculate compliance costs, cut and simplify business regulations (consisting of regulations on administrative procedures including those on reporting; regulations on business requirements and conditions; regulations on specialized inspection of imports and exports; regulations on standards and technical regulations) set forth in circulars and joint circulars of ministers and heads of ministerial agencies, decisions of the Prime Minister, decisions and resolutions of the Government, laws and resolutions of the National Assembly, ordinances and resolutions of the Standing Committee of the National Assembly which are all effective, and in drafts of legislative documents which ministries and agencies are assigned to formulate and promulgate within their power or request a competent authority to promulgate.

III. BASIC TASKS

1. In 2020, focus on important tasks to pave the way for the next years. To be specific:

a) Design and put into use software intended for producing statistics on and reviewing business regulations (hereinafter referred to as “the statistical software”).

b) Provide training and improve competence of Ministries, ministerial agencies and Governmental agencies in producing statistics and calculating compliance costs, and review and assessment of business regulations.

(An Appendix: Plans to cut and simplify business regulations in 2020 is enclosed herewith).

2. On an annual basis, Ministries, ministerial agencies and Governmental agencies shall promulgate and organize implementation of the plans to cut and simplify business regulations in order to promptly cut and simplify unreasonable regulations which are hindering business activities.

3. Regularly update business regulations that are amended, supplemented or repealed and changes in compliance costs on the statistical software for the purpose of monitoring the cutting and simplification of business regulations, and cuts and simplifications.

4. Receive, collect and consolidate comments and feedback of enterprises and the people on unreasonable regulations hindering business activities through the National Public Service Portal, dialogues or consultations to propose regulations that need reviewing, cutting and simplifying first; request competent authorities to amend, supplement, replace or repeal regulations.

5. Strictly control business regulations by assessing impacts of regulations that require enterprises and the people to incur compliance costs, and the evaluation and verification carried out in the process of appraising and promulgating legislative documents.

6. Prepare preliminary reports on and assess the implementation of the annual plans to cut and simplify business regulations and results thereof, and conduct a general review of the Program.

7. Prepare and organize implementation of the communication plan to communicate results obtained to the people and enterprises during execution of the Program.

IV. MAJOR SOLUTIONS

1. Strengthen the provision of instructions by the Government, Prime Minister, Ministries, ministerial agencies, Governmental agencies and People's Committees at all levels on cutting and simplifying business regulations to improve investment climate, facilitate and create an equal environment for business activities of enterprises and the people.

3. Regularly instruct, inspect and supervise performance of assigned tasks by ministries, ministerial agencies and Governmental agencies to ensure that regulations on schedule, quality, objectives and requirements of the Program are satisfied.

4. Improve quality of cooperation between ministries and agencies in appraising and verifying legislative documents and resolving issues and difficulties related to multiple ministries and agencies.

5. Develop information technology in a synchronous and parallel manner and reciprocally apply information technology to production of statistics, review and calculation of costs of compliance with business regulations, submit consolidated reports on cuts and simplifications in business regulations and effectively hold consultations on policies and legislative documents to collect comments of enterprises and the people.

6. Speed up effective communication and implementation of the Government’s Decree No. 61/2018/ND-CP and Decree No. 45/2020/ND-CP, connect, integrate and provide online public services and online payment services on the National Public Service Portal to serve the people and enterprises.

7. Increase awareness, responsibility and capacity of state administrative agencies, organizations and individuals joining the Program; strengthen supervision by media agencies, press agencies, enterprises and the people of results of reform, cutting and simplification of business regulations that are no longer reasonable hindering business activities.

V. FUNDING FOR EXECUTION

1. Funding for execution of the Program is covered by the state budget and allocated to ministries, ministerial agencies, Governmental agencies and People's Committees of provinces and central-affiliated cities within the current state budget.

2. Ministries, ministerial agencies, Governmental agencies and People's Committees of provinces and central-affiliated cities shall include the funding for performing the tasks specified in the Program in the annual budget estimate given by the competent authority.

3. The raising of off-budget capital for execution of the Program is encouraged.

1. Ministries, ministerial agencies and Governmental agencies shall:

a) proactively execute the Program as assigned, consider this as one of the key tasks in the 2020 - 2025 period. Heads of Ministries, ministerial agencies and Governmental agencies shall be responsible to the Government and the Prime Minister for cuts and simplifications in unreasonable regulations hindering business activities, ensuring that objectives and requirements mentioned the Program are fulfilled; disseminate the Government's instructions on the Program to every single official, public official and public employee under their management.

b) according to this Program, the Prime Minister's direction and current execution of the Program at Ministries and agencies, Ministries, every ministerial agency and Governmental agency shall prepare and promulgate a Plan to cut and simplify business regulations by January 31 every year, and submit it to the Office of the Government (in 2020, promulgate it within 20 days from the date on which the Government promulgates the Resolution).

c) Complete the statistical production, data updating and calculation of costs of compliance with business regulations under the management of Ministries and ministerial agencies on the statistical software under the guidance of the Office of the Government by October 15, 2020; submit a consolidated report on statistical results and results of calculation of costs of compliance with business regulations under the management of Ministries and ministerial agencies by October 31, 2020 to the Office of the Government; regularly update business regulations that are amended, supplemented, replaced or repealed and changes in compliance costs on the statistical software.

d) Preside over and cooperate with ministries, agencies concerned, Advisory Council for Administrative Procedure Reform in reviewing, cutting and simplifying business regulations under their management; prepare plans to cut and simplify business regulations and submit them to the Prime Minister by October 31, 2020, from 2021 to 2025, submit the plans to the Prime Minister by May 30 and by September 30. Before being submitted to the Prime Minister, the plans must be sent to Ministries and agencies concerned to collect their comments (the plan to cut and simplify regulations on specialized inspection of imports and exports must be submitted to the Ministry of Finance to collect its comments).

dd) Regularly hold dialogues or consultations, receive and collect comments of organizations, business associations and other entities about unreasonable regulations hindering business activities; about solutions and plans for cutting and simplifying business regulations, and proposed amendments to business regulations hindering business regulations to remove difficulties in business activities facing enterprises and the people.

e) Formulate, promulgate and propose promulgation of documents serving the execution of plans to cut and simplify (amend, supplement, replace or repeal) business regulations under the management of ministries and ministerial agencies after the plans are approved by the Prime Minister.

g) By June 25 and December 25, submit mid-year and annual consolidated reports on cuts and simplifications in business regulations to the Office of the Government, which will submit them to the Government and the Prime Minister.

2. The Office of the Government shall:

b) Preside over designing and putting statistical software into use, preparing documents and instructing Ministries, ministerial agencies and Governmental agencies to produce statistics, calculate compliance costs, review and assess business regulations in May 2020; cooperate with the Ministry of Planning and Investment in connecting and sharing data on business regulations to assist Ministries and agencies in enumerating, updating and adding business regulations, completed by June 2020.

c) Provide training and improve competence of Ministries, ministerial agencies and Governmental agencies in production of statistics, calculation of compliance costs, review and assessment of business regulations, completed by June 2020.

d) Frequently consolidate comments and feedback of enterprises, the people, organizations and business associations on unreasonable regulations hindering business activities through the National Public Service Portal, dialogues and consultations.

dd) Consider and comment on statistical results and results of calculation of compliance costs and execution of plans to cut and simplify business regulations of Ministries, ministerial agencies and Governmental agencies.

e) Assist the Prime Minister in supervising and inspecting Ministries and agencies for performing the tasks of producing statistics, reviewing, calculating compliance costs, cutting and simplifying business regulations according to the annual plans, ensuring that objectives and requirements of the Program are fulfilled.

g) Preside over and cooperate with Ministries, ministerial agencies, Governmental agencies and Advisory Council for Administrative Procedure Reform in independently reviewing business regulations which involve multiple ministries or on which multiple comments and feedback are given by enterprises and the people; on that basis, recommend solutions to the Government and the Prime Minister.

h) Instruct Ministries, ministerial agencies and Governmental agencies to prepare a preliminary report and carry out assessment of the statistical production, calculation of compliance costs, review, cutting and simplification of business regulations. Conduct preliminary review and assess the implementation of the annual plan and results thereof by December 31 and conduct general review of the Program by December 31, 2025.

i) Regularly publish cuts and simplifications in business regulations made by Ministries and ministerial agencies on the Government’s web portal.

k) Cooperate with Ministries, ministerial agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities and news agencies in disseminating information about execution of this Program and results thereof.

a) perform the tasks mentioned in Clause 1 of this Section.

b) Preside over and cooperate with Ministries and agencies concerned in implementing the plan to review legislative documents under the state management of Ministries and ministerial agencies enclosed with the Decision No. 209/QD-TTg dated February 07, 2020 and directions given by the Permanent Deputy Prime Minister Truong Hoa Binh in the Notification No. 136/TB-VPCP dated April 01, 2020 of the Office of the Government.

c) Preside over and cooperate with the Office of the Government, Ministries and agencies concerned in the process of appraising drafts of the documents serving the execution of plans to cut and simplify business regulations under the management of Ministries and ministerial agencies within the power to promulgate of the National Assembly, Standing Committee of National Assembly, Government and Prime Minister in accordance with regulations of law, ensuring that objectives and requirements of the Program are fulfilled.

d) Receive and consolidate proposals from Ministries and ministerial agencies, make and request the Government to approve the Government’s requests for the law/ordinance formulation program; request the Prime Minister to assign one Ministry or ministerial agency to preside over formulating a document serving the execution of plans to cut and simplify business regulations (if permitted by the competent authority to adopt the method: Amendments to multiple documents are included in one document).

4. The Ministry of Finance shall:

a) perform the tasks mentioned in Clause 1 of this Section.

b) cut and simplify customs procedures towards digitization and electronic customs in accordance with international standards; preside over setting up a project on reform of specialized inspections as assigned by the Government in the Resolution No. 99/NQ-CP dated November 13, 2019. 

c) Closely cooperate with the Office of the Government and relevant ministries in the process of reforming regulations on specialized inspection of imports and exports; comment on plans to cut and simplify regulations on specialized inspection of imports and exports when requested by ministries.

d) Recommend ministries or the Prime Minister to direct ministries to review, cut and simplify regulations on specialized inspection of imports and exports.

a) proactively participate and encourage participation by associations, enterprises and the people in sending comments and feedback on difficulties and barriers to business activities specified in legislative documents, administrative documents and drafts of legislative documents to the Office of the Government, which will submit a consolidated report to the Prime Minister.

b) promptly recommend solutions for resolving difficulties in business activities facing enterprises to the Prime Minister.

6. People’s Committees of provinces and central-affiliated cities shall:

a) promptly send ministries comments and feedback on difficulties and inadequacies in implementing business regulations.

b) Consider and comment on plans to cut and simplify business regulations as requested by Ministries, ministerial agencies and Governmental agencies.

c) Speed up effective communication and implementation of the Government’s Decree No. 61/2018/ND-CP and Decree No. 45/2020/ND-CP, connect, integrate and provide online public services and online payment services on the National Public Service Portal.

VII. IMPLEMENTATION

1. This Resolution comes into force from the date on which it is signed.

2. Ministers, heads of ministerial agencies, heads of Governmental agencies, Presidents of People’s Committees of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Resolution./.
