TO APPROVE THE PLAN ON VIETNAM'S RADIO FREQUENCY SPECTRUM FOR SERVICES
THE PRIME MINISTER
Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to Decree No. 109/1997/ND-CP of December 11, 1997 of the Government on Post and Telecommunications;
At the proposals of the General Director of the General Department of Post and Telecommunications in Document No. 338/CTS of March 14, 1998 of the Chairman of the Radio Frequency Board in Document No. 61/UBTS of February 25, 1996,
DECIDES:
Article 1.- To approve Vietnam's plan on the radio frequency spectrum for services with the following contents:
I. OBJECTIVES OF THE PLAN
The radio frequency spectrum is a rare and precious natural resource. The use, operation and management of the radio frequency spectrum must be effective, rational, economical and must protect the national sovereignty.

II. FUNDAMENTAL PRINCIPLES FOR THE FORMULATION OF THE PLAN
1. The State exercises uniform management over radio frequencies and radio transmitters.
2. To manage and exploit the radio frequency spectrum in an effective, rational and economical manner while ensuring the national interests and sovereignty.
3. To ensure communication safety and national security.
4. To comply with the International Telecommuni-cation Union (ITU)'s Regulations on the allocation of frequencies to radiocommunication services.
5. To take into account the characteristics in the present use of Vietnam's radio frequency spectrum, ensuring the transition under the new plan at the lowest costs, without affecting the operation of the national important communication networks.
6. To give priority to the use of bands for new technologies to meet the demand of radio bands for services in Vietnam in the period from 10 to 15 years ahead.
7. To reserve a number of bands exclusively for security and defense purposes according to a proportion suitable to the country's political tasks in each period.
III. CONTENTS AND PRINCIPAL TASKS OF THE PLAN

1. The plan on the radio frequency spectrum for services:
The plan on the radio frequency spectrum for services covers the division of the bands of from 9 kHz to 400 GHz into smaller bands and the determination of purposes and conditions for use of such bands. The detailed contents of this plan are shown in the Table of Allocation of the Frequency Spectrum for Services, which is presented in Document No. 338/CTS of March 14, 1998 of the General Department of Post and Telecommunications.
The main radiocommunication services include: fixed, mobile, broadcasting (radio and television), aeronautical, maritime, navigation, location, satellite, standard broadcasting, etc., services.
The plan on the radio frequency spectrum for services is the most important content, serving as a basis for the ministries and branches to determine the orientations for the use of radio frequency bands and the investment in radio technical equipment, as well as a basis for elaborating detailed planning phases (channel planning and reuse planning).
2. Channel planning and reuse planning:
Channel planning is the division of a number of bands into groups of specific frequency channels for specific radio systems in conformity with the plan on the radio frequency spectrum for services so as to ensure the technical criteria.
Reuse planning is the establishment of zones for re-using frequencies in the ultra-high frequency band so as to raise the efficiency in the use of the frequency spectrum, in order to meet the development requirements of the telecommunications, radio and television services.
The General Department of Post and Telecom-munications shall implement these plans on the basis of the plan on the radio frequency spectrum for services already approved by the Prime Minister.
B. THE PRINCIPAL TASKS FOR IMPLEMENTING THE PLAN:

2. To build an international registration and coordination system in order to guarantee the national interests and protect the national sovereignty regarding radio frequencies and satellite orbit.
3. To complete the building of regional control centers, continue to modernize frequency control and supervision equipment and facilities. To be able to regularly control 100 per cent of the key areas and at least 50 per cent of the national territory by the year 2000.
4. On the basis of the plan of Vietnam's radio frequency spectrum for services, to complete the allocation of the frequency spectrum in service of security and defense.
5. To register and coordinate with the International Telecommunication Union and the concerned countries so as to have before the year 2000 at least one geostationery satellite orbit for Vietnam's satellite telecommunications project.
IV. ORGANIZATION OF THE IMPLEMENTATION OF THE PLAN
1. On the basis of the contents and principal tasks of the plan, the General Department of Post and Telecommunications shall coordinate with the concerned ministries and branches in issuing legal documents and guiding circulars so as to popularize the plan's contents to the subjects that use frequencies, manufacture, import or export radio equipment.
2. The contents and tasks of the plan should be incorporated into the annual and long-term plans, development programs and specific investment projects.
3. In the course of implementation of the plan, the General Department of Post and Telecommuni-cations and the Radio Frequency Board shall be permitted to adjust the plan to make it comply with new international regulations while taking into account Vietnam's actual conditions. Major and important adjustments must be permitted by the Prime Minister.
Article 2.- The General Department of Post and Telecommunications shall have to guide and supervise the implementation of the plan.

Article 4.- The ministers, the heads of the ministerial-level agencies and agencies attached to the Government and the presidents of the People's Committees of the provinces and cities directly under the Central Government shall have to organize the implementation of this Decision.

Together with the plan on the development of the post and telecommunications service, the plan on Vietnam's radio frequency spectrum for services shall contribute to the development of the radio communication network along the direction of modernization, synchronization and long-term stabilization in line with the international development trend, meeting the information demands in service of socio-economic development, defense and security, creating a basis for the socialization of information by the turn of the 21st century.
PRINCIPLES, CONTENTS AND MAIN TASKS OF THE PLAN

1. Division of regions by the International Telecommunication Union (ITU)
REGION 1:
Region 1 includes the areas limited on the east by line A and on the west by line B, excluding any of the territory of Iran which lies between theses limits. It also includes that part of the territory of Turkey and the former Soviet Union lying outside these limits, the territory of the Mongolian People's Republic, and the area to the north of the former Soviet Union, which lies between lines A and C.
REGION 2:
Region 2 includes the areas limited on the east by line B and the west by line C.
REGION 3:
Region 3 includes the areas limited on the east by line C and on the west by line A, except the territories of the Mongolian People's Republic, Turkey, the territory of the former Soviet Union, and the area to the north of the former Soviet Union. It also includes that part of the territory of Iran lying outside those limits.

2.1. General terms

2.1.2. Telecommunication: Any transmission, emission or reception of signs, signals, writing, images and sounds or intelligence of any nature by wire, radio, optical or other electromagnetic systems.
2.1.3. Radio: A general term applied to the use of radio waves.
2.1.4. Radio Waves or Hertzian Waves: Electromagnetic waves of frequencies arbitrarily lower than 3000 GHz, propagated in space without artificial guide.
2.1.5. Radiocommunication: Telecommunication by means of radio waves (CONV.).
2.1.6. Terrestrial Radiocommunication: Any radiocommunication other than space radiocommunication or radio astronomy.
2.1.7. Space Radiocommunication: Any radio-communication involving the use of one or more space stations or the use of one or more reflecting satellites or other objects in space.
2.1.8. Radiodetermination: The determination of the position, velocity and/or other characteristics of an object, or the obtaining of information relating to these parameters, by means of the propagation properties of radio waves.
2.1.9. Radionavigation: Radiodetermination used for the purposes of navigation, including obstruction warning.
2.1.10. Radiolocation: Radiodetermination used for purposes other than those of radionavigation.

2.1.12. Radio Astronomy: Astronomy based on the reception of radio waves of cosmic origin.
2.1.13. Coordinated Universal Time (UTC): Time scale, based on the second, as defined and recommended by the CCIR, and maintained by the International Time Bureau.
For most practical purposes associated with the Radio Regulations, UTC is equivalent to mean solar time at the prime meridian (0o longitude), formerly expressed in GMT.
2.1.14. Industrial, Scientific and Medical (ISM) Applications (of radio frequency energy): Operation of equipment or appliances designed to generate and use locally radio frequency energy for industrial, scientific, medical, domestic or similar purposes, excluding applications in the field of telecom-munications.
2.2. Terms Related to Radio Frequency Management
2.2.1. Allocation (of a frequency band): Entry in the Table of Frequency Allocations of a given frequency band for the purpose of its use by one or more terrestrial or space radiocommunication services or the radio astronomy service under specified conditions. This term shall also be applied to the frequency band concerned.
2.2.2. Allotment (of a radio frequency or radio frequency channel): Entry of a designated frequency channel in an agreed plan, adopted by a competent conference, for use by one or more administrations for a terrestrial or space radiocommunication service in one or more identified countries or geographical areas and under specified conditions.
2.2.3. Assignment (of a radio frequency or radio frequency channel): Authorisation given by an administration for radio station to use a radio frequency or radio frequency channel under specified conditions.

In these Regulations, unless otherwise stated, any radiocommunication service relates to terrestrial radiocommunication.
2.3.2. Fixed Service: A radiocommunication service between specified fixed points.
2.3.3. Fixed-Satellite Service: A radiocommunication service between earth stations at given positions, when one or more satellites are used; the given positions may be a specified fixed point or any fixed point within specified areas; in some cases this service includes satellite-to-satellite links, which may also be operated in the inter-satellite service; the fixed-satellite service may also include feeder links for other space radiocommunication services.
2.3.4. Aeronautical Fixed Service: A radiocommunication service between specified fixed points provided primarily for the safety of air navigation and for the regular, efficient and economical operation of air transport.
2.3.5. Inter-Satellite Service: A radiocommunication service providing links between artificial satellites.
2.3.6. Space Operation Service: A radiocommunication service concerned exclusively with the operation of spacecraft, in particular space tracking, space telemetry and space telecommand.
These functions will normally be provided within the service in which the space station is operating.
2.3.7. Mobile Service: A radiocommunication service between mobile and land stations, or between mobile stations (CONV.).
2.3.8. Mobile-Satellite Service: A radiocommunication service:

This service may also include feeder links necessary for its operation.
2.3.9. Land Mobile Service: A mobile service between base stations and land mobile stations, or between land mobile stations.
2.3.10. Land Mobile-Satellite Service: A mobile-satellite service in which mobile earth stations are located on land.
2.3.11. Maritime Mobile Service: A mobile service between coast stations and ship stations, or between ship stations, or between associated on-board communication stations; survival craft stations and emergency position-indicating radiobeacon stations may also participate in this service.
2.3.12. Maritime Mobile-Satellite Service; A mobile-satellite service in which mobile earth stations are located on board ships; survival craft stations and emergency position-indicating radiobeacon stations may also participate in this service.
2.3.13. Port Operation Service: A maritime mobile service in or near a port, between coast stations and ship stations, or between ship stations, in which messages are restricted to those relating to the operational handling, the movement and the safety of ships and, in emergency, to safety of persons.
Messages which are of a public correspondence nature shall be excluded from this service.
2.3.14. Ship Movement Service: A safety service in the maritime mobile service other than a port operations service, between coast stations and ship stations, or between ship stations, in which messages are restricted to those relating to the movement of ships.

Aeronautical Mobile Service: A mobile service between aeronautical stations and aircraft stations, or between aircraft stations, in which survival craft stations may participate; emergency position-indicating radiobeacon stations may also participate in this service on designated distress and emergency frequencies.
2.3.15A. Aeronautical Mobile (R)* Service: An aeronautical mobile service reserved for communications relating to safety and regularity of flight, primarily along national or international civil air routes.
2.3.15B. Aeronautical Mobile (OR)** Service: An aeronautical mobile service intended for communications, including those relating to flight coordination, primarily outside national or international civil air routes.
2.3.16. Aeronautical Mobile-Satellite Service: A mobile-satellite service in which mobile earth stations are located on board aircraft; survival craft stations and emergency position-indicating radio-beacon stations may also participate in this service.
2.3.16A. Aeronautical Mobile-Satellite (R)* Service: An aeronautical mobile-satellite service reserved for communications relating to safety and regularity of flights, primarily along national or international civil air routes.
2.3.16B. Aeronautical Mobile-Satellite (OR)** Service: An aeronautical mobile-satellite service intended for communications, including those relating to flight coordination, primarily outside national and international civil air routes.
2.3.17. Broadcasting Service: A radiocommunication service in which the transmissions are intended for direct reception by the general public. This service may include sound transmissions, television transmissions or other types of transmission.
2.3.18. Broadcasting- Satellite Service: A radio-communication service in which signals transmitted or retransmitted by space stations are intended for direct reception by the general public.
In the broadcasting-satellite service, the term "direct reception" shall encompass both individual reception and community reception.

- Information relating to the charateristics of the earth and its natural phenomena, including data relating to the state of the environment, is obtained from active sensors or passive sensors on earth satellites;
- Similar information is collected from airborne or Earth-based platforms;

2.3.30. Meteorological-Satellite Service: An earth exploration-satellite service for meteorological purposes.
2.3.31. Standard Frequency and Time Signal Service: A radiocommunication service for scientific, technical and other purposes, providing the transmission of specified frequencies, time signals, or both, of stated high precision, intended for general reception.
2.3.32. Standard Frequency and Time Signal-Satellite Service: A radiocommunication service using space stations on earth satellites for the same purposes as those of the standard frequency and time signal service.
This service may also include feeder links necessary for its operation.
2.3.33. Space Research Service: A radiocommunication service in which spacecraft or other objects in space are used for scientific or technological research purposes.
2.3.34. Amateur Service: A radiocommunication service for the purpose of self-training, intercommunication and technical investigations carried out by amateurs, that is, by duly authorised persons interested in radio technique solely with a personal aim and without pecuniary interest.
2.3.35. Amateur-Satellite Service: A radiocommunication service using space stations on earth satellites for the same purposes as those of the amateur service.

2.3.37. Safety Service: Any radiocommunication service used permanently or temporarily for the safeguarding the human life and property (CONV.).
2.3.38. Special Service: A radiocommunication service, not other wise defined in this Section, carried on exclusively for specific needs of general utility, and not open to public correspondence.
3. Structure of the table of allocation of the frequency spectrum
3.1 Column 1: The frequency bands arranged in the order from 9kHz to 400GHz, are subdivided and allocated to various communication services.
3.2 Column 2: Permitted communication services in a given frequency band under the specific conditions set by the International Telecommunication Union for Region 3.
3.3. Column 3: Permitted services in a given frequency band under the specific conditions set by Vietnam.
3.4. In each box of Column 2 or Column 3:
+ Permitted services in the same frequency band of such box.
+ The order of listing of services in the box does not indicate priority for services which are listed first.

Primary services and secondary services:
Where, in a box of the Table of Allocation of the Frequency Spectrum, a band is indicated as allocated to more than one service, such services are listed in the following order:
- Services the names of which are printed in capitals (for example: FIXED), these are called "primary" services.
- Additional remarks shall be printed in normal letters (for example: MOBILE except aeronautical mobile).
- Services the names of which are printed in small letters (for example: fixed), these are called "secondary" services.
- Stations of a secondary service:
- Shall not cause harmful interference to stations of primary services to which frequencies are already assigned or to which frequencies may be assigned at a later date.
- Cannot claim protection from harmful interference from stations of a primary service to which frequencies are already assigned or to which frequencies may be assigned at a later date.
- Can claim protection, however, from harmful interference from stations of the same or other secondary service(s) to which frequencies may be assigned at a later date.

On the basis of the contents and principal tasks of the plan, the General Department of Post and Telecommunications shall coordinate with the concerned ministries and branches to issue legal documents and guiding circulars so as to popularize the plan's contents to the subjects that use frequencies, manufacture, import or export radio equipment.

In the course of implementation of the plan, the General Department of Post and Telecommuni-cations and the Radio Frequency Board shall be permitted to adjust the plan to make it comply with new international regulations while taking into account Vietnam's actual conditions. Major and important adjustments must be permitted by the Prime Minister.-
