DECISION

APPROVED FREQUENCY BANDS PUT UP FOR AUCTION   

PRIME MINISTER

Pursuant to the Law on organization of the government dated December 25, 2001;

Pursuant to the Law on radio frequencies dated November 23, 2009;

Pursuant to the Law on telecommunications dated November 23, 2009;

Pursuant to Decision No. 71/2013/QD-TTg dated November 21, 2013 by Prime Minister on the national radio frequency planning;

Pursuant to Decision No. 16/2012/QD-TTg dated August 03, 2012 by Prime Minister on auction and transfer of right to use radio frequencies;

Pursuant to Decision No. 32/2012/QD-TTg dated July 27, 2012 approving the Planning for development of national telecommunications up to 2020;

In consideration of the request of Minister of Information and Communications;

DECIDES:

Article 1. The following frequency bands are permitted to be put up for auction:

1. 2300 - 2400 MHz band, 2500 - 2570 MHz band and 2620 - 2690 MHz band for operation of mobile phone system according to IMT standards.

2. The use duration of bands put up for auction is defined in the license to use radio frequencies granted by Ministry of Information and Communications in conformity with the Law on radio frequencies.

Article 2.

1. Minister of Information and Communications is assigned to organize the auction of right to use radio frequencies in bands prescribed in Article 1 herein.

2. The time of auction shall be decided by Minister of Information and Communications on the basis of the planning for development of national telecommunications, actual market demand, the universalization of technologies and services, and guarantee of healthy competition in telecommunications activities.

Article 3. This Decision takes effect as of the date on which it is signed.

Ministers, Heads of ministerial-level agencies and the Government's affiliates and Chairpersons of people’s committees of central-affiliated cities or provinces shall implement this Decision./.
