PROMULGATING ENVIRONMENTAL CODE OF CONDUCT FOR CULTURAL, SPORTS AND TOURIST ACTIVITIES

MINISTER OF CULTURE, SPORTS AND TOURISM

Pursuant to the 2014 Law on Environmental Protection;

Pursuant to the Government’s Decree No. 79/2017/ND-CP dated July 17, 2017 on functions, duties, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Joint Circular No. 19/2013/TTLT-BVHTTDL-BTNMT dated December 30, 2013 by the Minister of Culture, Sports and Tourism and Minister of Natural Resources and Environment providing guidelines for environmental protection in tourist activities and festivals and monument value protection and promotion;

Pursuant to Decision No. 1341/QD-BVHTTDL dated May 14, 2020 by the Minister of Culture, Sports and Tourism approving environmental task of formulation of environmental code of conduct for cultural, sports and tourist activities;

Pursuant to Official Dispatch No. 6520/BTNMT-TCMT dated November 18, 2020 by the Minister of Culture, Sports and Tourism on commentary on draft environmental code of conduct for cultural, sports and tourist activities;

HEREBY DECIDES:

Article 1. Promulgated together with this Decision is the environmental code of conduct for cultural, sports and tourist activities (hereinafter referred to as “Code of Conduct”).

Article 2. Department of Science Technology and Environment shall disseminate the Code of Conduct and provide relevant regulatory bodies and units with guidelines on implementation thereof; submit consolidated proposals for and assessments of such implementation to the Ministry of Culture, Sports and Tourism.

Article 3. This Decision takes effect from the date on which it is signed.

Article 4. Chief of Ministry Office, Director General of Department of Science Technology and Environment, Director General of Department of Planning and Finance, heads of relevant regulatory bodies and units, and Directors of Departments of Culture, Information, Sports and Tourism; Departments of Culture, Sports and Tourism; Departments of Culture and Sports; and Departments of Tourism of provinces and central-affiliated cities shall implement this Decision./.

ENVIRONMENTAL CODE OF CONDUCT

FOR CULTURAL, SPORTS AND TOURIST ACTIVITIES

Article 1. Objectives

1. Raise awareness and promote acts of environmental protection of relevant entities in cultural, sports and tourist activities.

2. Enhance communications activities and help create a green - clean - beautiful environment at locations of cultural, sports and tourist activities.

Article 2. Scope and regulated entities

1. Scope

It is encouraged to implement this Code of Conduct in facilities and at locations where cultural, sports and tourist activities take place (hereinafter referred to as “activity locations”).

a) Organizations and individuals involved in activity location management and protection.

b) Organizations and individuals involved in performances, competitions and business at activity locations.

c) Tourists, visitors and audiences at activity locations.

d) Residential communities at activity locations.

Article 3. General code of conduct at activity locations

1. Enhance responsibility for compliance with regulations of law on environmental protection; proactively raise awareness of environmental protection; and foster eco-friendly attitude and behaviors.

2. Proactively participate in activities, movements, models and events concerning environmental protection and response to climate change; proactively exercise rights of and fulfill responsibility for environmental protection and encourage others to join.

3. Criticize, prevent and promptly notify environmentally damaging acts at activity locations to the authority.

4. Do not destroy the environment for economic gain.

1. Follow the general code of conduct provided for in Article 3 herein.

2. Encourage organizations and individuals to comply with regulations of law on environmental protection when participating in cultural, sports and tourist activities at activity locations.

3. Promulgate and publish regulations on public hygiene and environmental protection in areas under their management and organize implementation thereof.

4. Provide sufficient qualified restrooms according to demand.

5. Reduce waste; provide equipment for collection and classification of waste at source, dispose of waste as per the law, and manage and handle waste in compliance with environmental protection requirements.

6. Properly adhere to regulations on tobacco harm prevention, place no smoking signs at locations where smoking is prohibited.

7. Assign workers for environmental cleaning and inspection of compliance with regulations on environmental protection.

8. Build, operate and maintain wastewater collection and treatment systems meeting technical standards and regulations on domestic wastewater; it is encouraged to apply modern and eco-friendly technology at activity locations.

9. Use electricity, water, fuels and cleaning agents economically; increase use of eco-friendly materials and renewable energy (solar power, wind, etc.) in areas with potential or advantages.

11. Support policies and solutions for reduction and elimination of single-use plastic and non-biodegradable nylon bags at activity locations.

12. Collect, consolidate and report opinions and propositions in relation to environmental protection from organizations and individuals to competent authorities.

13. Closely cooperate with environmental protection inspection teams; promptly provide sufficient and accurate information on the environment at activity locations; take or propose actions against environmentally damaging acts as per the law.

14. Provide funding for environmental protection or formulate plans for environmental protection funding and plans for response to environmental emergencies and propose to competent authorities for consideration and approval.

15. Commend organizations and individuals with achievements in environmental protection at activity locations.

Article 5. Environmental code of conduct for organizations and individuals involved in performances, competitions and business at activity locations

1. Follow the general code of conduct provided for in Article 3 herein.

2. Comply with regulations on environmental protection.

3. Do not trade wild animals or consume products from wild animals included in lists of endangered, precious and rare species whose protection is prioritized and items originating from ecosystems and geologic structures of activity locations (stalactites, corals, etc.); do not bring alien species harmful to the environment or humans to activity locations.

5. Be good examples, and honor responsibilities and obligations concerning formation and protection of green - clean - beautiful landscape at activity locations.

Article 6. Environmental code of conduct for tourists, visitors, audiences and residential communities at activity locations

1. Follow the general code of conduct provided for in Article 3 herein.

2. Comply with regulations and guidelines on environmental protection.

3. Do not smoke in no smoking areas.

4. Use restrooms properly; keep public hygiene and remind others to keep public hygiene.

5. Do not harm the environment, flora and fauna at activity locations; do not write, draw or carve inside caves or onto trees or other factors forming activity locations.

6. Do not carry weapons, explosives, flammables, hazardous substances or pollutants to activity locations.

7. Do not trade or consume wild flora and fauna or products originating from wild flora and fauna.

9. Support policies for economical use of power and water and avoid using cleaning agents.

10. Participate in and assist environmental protection activities organized by activity location managers.

Article 7. Implementation

1. Organizations and individuals shall proactively and voluntarily implement this Code of Conduct when participating in cultural, sports and tourist activities.

2. Departments of Culture, Information, Sports and Tourism; Departments of Culture, Sports and Tourism; Departments of Culture and Sports and Departments of Tourism of provinces and central-affiliated cities shall research and implement this Code of Conduct in their provinces and cities within their competence.

3. Heads of affiliates of the Ministry of Culture, Sports and Tourism shall disseminate this Code of Conduct and organize implementation thereof in their organizations and areas under their management within their competence.

4. Department of Science Technology and Environment shall take charge of implementation of and provide guidelines for this Code of Conduct.

5. Heads of press agencies and ministry-affiliated information centers shall publish articles about this Code of Conduct and disseminate this Code of Conduct via online news sites, magazines and newspapers under their management.
