ON THE APPLICATION OF AUTOMATIC IMPORT LICENSING TO SOME COMMODITY ITEMS
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Government’s Decree No. 189/2007/ND-CP of December 27, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding international goods trading and goods trading agency, processing and transit with foreign parties;
Pursuant to the Prime Minister’s Decision No. 41/2005/QD-TTg of March 2, 2005, promulgating the Regulation on goods import licensing;
At the proposal of the director of the Import and Export Department,
DECIDES:
Article 1.- To apply automatic import licensing to commodity items on the list shown in Appendix 1 to this Decision.
Article 2.- The temporary import for re-export, temporary export for re-import, transfer out of border gate, transit, non-commercial import, and import of goods for the production and processing of goods for export for foreign parties are not governed by this Decision and comply with current regulations.
Article 3.- Automatic import licenses shall be granted in the form of certification of a trader’s registration of import for each goods lot. The director or deputy director of the Import and Export Department is responsible for such certification.
Article 4.- A dossier of application for automatic import licensing comprises:

- The business registration certificate: one copy (appended with the trader’s true copy mark), for traders that register for the first time the import of goods.
- The import contract: one copy (appended with the trader’s true copy mark).
- L/C, payment document or the bank’s payment certification: one copy (appended with the trader’s true copy mark).
- Bill of lading or transportation document for the goods lot: one copy (appended with the trader’s true copy mark).
- The report on the import situation, made according to the form in Appendix 3 to this Decision (not printed herein), for goods lots with licenses (if any) already granted by the Ministry of Industry and Trade, enclosed with the customs declarations containing the certification of the actual importation of the goods lots (appended with the trader’s true copy mark).
Article 5.- Dossiers (of application for licensing) shall be sent by post or submitted directly to the correspondence section of the Ministry of Industry and Trade. Officials in charge of licensing may not personally receive dossiers.
Article 6.- The time limit for automatic licensing is 10 working days after the Ministry of Industry and Trade receives a complete and valid dossier.
Article 7.- When carrying out import procedures, a trader shall, in addition to the import dossier set under current regulations, produce to the customs office one import registration application already certified by the Ministry of Industry and Trade.
Article 8.- Within 5 days after completing customs procedures for an imported goods lot, the trader shall send to the Ministry of Industry and Trade a report on the import, made according to the form in Appendix 3 to this Decision (not printed herein).

Article 10.- The director of the Ministry’s Office, the director of the Import and Export Department, heads of units under the Ministry, traders and concerned agencies shall implement this Decision.
