CIRCULAR

FEES FOR APPRAISING AND LICENSING SURVEY, EXTRACTION AND USE OF WATER RESOURCES; RELEASE OF WASTEWATER INTO WATER SOUCES AND PRACTICE OF GROUNDWATER DRILLING BY CENTRAL GOVERNMENT AUTHORITIES AND FEES FOR EXTRACTION AND USE OF METEOROLOGY AND HYDROLOGY INFORMATION AND DATA AND COLLECTION, SUBMISSION THEREOF

Pursuant to Law on Fees and Charges dated November 25, 2015;

Pursuant to Decree No. 87/2017/ND-CP dated July 26, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the request of the Director General of the Department of Tax Policy,

Minister of Finance promulgates Circular on fees for appraising and licensing survey, extraction and use of water resources; release of wastewater into water sources and practice of groundwater drilling by central government authorities and fees for extraction and use of meteorology and hydrology information and data and collection, submission thereof.

Article 1. Fees for appraising and licensing survey, extraction and use of water resources; release of wastewater into water sources and practice of groundwater drilling by central government authorities

Agencies, organizations and individuals (including households) applying to competent regulatory agencies for appraising and licensing groundwater survey; licensing extraction and use of surface water; licensing extraction and use of groundwater; licensing extraction and use of sea water; licensing release of wastewater into water sources and practice of groundwater drilling shall submit fees as follows:

1. From May 5, 2020 to December 31, 2020 inclusively, submit fees equal to 80% of the fees under Schedule of fees attached to Circular No. 270/2016/TT-BTC dated November 14, 2016 of Minister of Finance on fees for appraising and licensing survey, extraction and use of water resources; release of wastewater into water sources and practice of groundwater drilling by central government authorities and collection, submission, management and use thereof (hereinafter referred to as “Circular No. 270/2016/TT-BTC”).

During the effective date of this Circular, do not submit fees for survey, extraction and use of water resources; release of wastewater into water sources and practice of groundwater drilling specified in Schedule of fees attached to Circular No. 270/2016/TT-BTC.

2. From January 1, 2021, submit fees for survey, extraction and use of water resources; release of wastewater into water sources and practice of groundwater drilling specified in Schedule of fees attached to Circular No. 270/2016/TT-BTC.

Article 2. Fees for extraction and use of meteorology and hydrology information and data

Agencies, organizations and individuals requesting National Centre for Hydro - Meteorological Forecasting affiliated to Ministry of Natural Resources and Environment to provide meteorology and hydrology information and data must submit fees for extraction and use of meteorology and hydrology information and data as follows:

1. From May 5, 2020 to December 31, 2020 inclusively, submit fees equal to 70% of the fees under Schedule of fees attached to Circular No. 197/2016/TT-BTC dated November 8, 2016 of Minister of Finance on fees for extraction and use of meteorology and hydrology information and data (hereinafter referred to as “Circular No. 197/2016/TT-BTC”).

During the effective period of this Circular, do not submit fees for extraction and use of meteorology and hydrology information and data according to Schedule of fees attached to Circular No. 197/2016/TT-BTC.

Regulations on submission of fees for extraction and use of meteorology and hydrology information and data do not apply to regulatory authorities that extract or use meteorology and hydrology information and data for purposes specified in Clause 2 Article 1 Circular No. 197/2016/TT-BTC.

2. From January 1, 2021, submit fees for extraction and use of meteorology and hydrology information and data as specified in Schedule of fees attached to Circular No. 197/2016/TT-BTC.

Article 3. Entry into force

1. This Circular is effective from May 5, 2020 until December 31, 2020 inclusively.

2. Details related to scope, regulated entities, organization of collecting, declaration, collection and submission of fees and charges; management and use of fees; certificates of collection, publicizing of fee and charge collection regimes and other relevant details not specified in this Circular shall comply with Circular No. 270/2016/TT-BTC and Circular No. 197/2016/TT-BTC.

3. Difficulties that arise during the implementation should be reported to Ministry of Finance for further notice./.
