DURATION OF EDUCATION DOCUMENT RETENTION
Pursuant to the Law on Education dated June 14, 2005 and the Law on amendments to the Law on Education dated November 25, 2009;
Pursuant to the Law on Archiving dated November 11, 2011;
Pursuant to the Government's Decree No. 32/2008/NĐ-CP dated March 19, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;
Pursuant to the Government's Decree No. 01/2013/NĐ-CP dated January 03, 2013 elaborating the Law on Archiving;
After reaching an agreement with the Ministry of Home Affairs as specified in Official Dispatch No. 5434/BNV-VTLTNN dated November 18. 2016;

Article 1. Scope and regulated entities
1. This Circular provides for durations of education document retention.
2. This Circular applies to units of The Ministry of Education and Training, Departments of Education and Training of provinces and districts; institutions of preschool education, institutions of compulsory education, continuing education institutions, pedagogy secondary schools, pedagogy colleges, universities, academies, other educational institutions, relevant organizations and individuals (hereinafter referred to as “organizations”).
Article 2. Education documents
1. An education document means an item that contains information and is created to serve education and training operations of an organization.
Education documents include physical documents, films, pictures, video or audio discs, electronic documents and other forms of information carriers.
2. Education dossier means a collection of education documents about an issue or subjects or that share common features.

2. The mandatory duration of retention of an education document means the necessary period of time over which the document has to be retained from the year in which the work is finished. Two types of document retention:
a) Permanent retention: Documents are retained until they are so badly decompose that cannot be recovered;
b) Limited-term retention: Documents are retained for certain years or a certain period of time.
3. Mandatory durations of retention of various categories of education documents are specified in the Education Document Retention Table enclosed herewith

2. The duration of retention of each document may be decided by the organization as long as it is not shorter than that provided for in the Table.
3. When putting a document in the archive, the organization must take into account the sufficiency of the text and points of time that may affect the retention duration.
4. When the retention period expires, a council of the organization shall consider destructing the document or extending the retention period.
5. The durations in the Table may be applied to documents that are not mentioned therein.
Article 5. Effect and responsibility for implementation
1. This Circular comes into force from February 15, 2017.
2. Chief of Office, Director of Planning and Finance Department, heads of affiliates of the Ministry of Education and Training; directors/principals of universities, pedagogy colleges and academies, Directors of Provincial Departments of Education and Training are responsible for the implementation of this Circular.
