CIRCULAR

PRESCRIBING FEES FOR ONLINE CERTIFICATE STATUS PROTOCOL MAINTENANCE, COLLECTION, TRANSFER, MANAGEMENT AND USE THEREOF

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Law on E-Transactions dated November 29, 2005;

Pursuant to the Law on State Budget dated June 25, 2015;

Pursuant to the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 elaborating and providing guidance on some Articles of the Law on Fees and Charges;

Pursuant to the Government’s Decree No. 130/2018/ND-CP dated September 27, 2018 elaborating some Articles of the Law on E-transactions on digital signatures and digital signature authentication.;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Finance;

The Minister of Finance hereby promulgates a Circular prescribing fees for online certificate status protocol maintenance, collection, transfer, management and use thereof.

Article 1. Scope and regulated entities

1. This Circular prescribes fees for online certificate status protocol maintenance, collection, transfer, management and use thereof.

2. This Circular applies to:

a) Organizations and enterprises issued with the license to provide digital signature authentication (hereinafter referred to as “enterprises”).

b) National Electronic Authentication Center affiliated to the Ministry of Information and Communications.

c) Other organizations and individuals related to collection and payment of fees for online certificate status protocol maintenance.

Article 2. Fee payers

Payers of fees for online certificate status protocol maintenance are enterprises issued with the license to provide digital signature authentication to organizations and individuals in accordance with regulations of law.

The National Electronic Authentication Center is the authority collecting fees for online certificate status protocol maintenance specified in this Circular.

Article 4. Fees

1. Fees for online certificate status protocol maintenance: VND 3,000/month/01 digital certificate issued by a digital signature authentication provider to a subscriber being an organization or enterprise (excluding individuals).

2. The fees specified in clause 1 of this Article shall be charged from the month in which the digital certificate issued to the subscriber is valid to the month preceding month in which the subscription expires. If the digital certificate is valid and expired in the same month, a full month's fees shall be charged.

Article 5. Fee declaration and transfer

1. Regarding fee payers

Fee payers shall declare and pay fees for online certificate status protocol maintenance to collectors on a quarterly basis on the 20th of the first month of the next quarter at the latest.

2. For collectors

a) Collectors shall transfer total amount of fees collected in the previous month to the designated state budget account opened at the State Treasury on the 5th of every month at the latest.

Article 6. Management and use of fees

Fee collectors may retain 85% of collected fees to cover their expenditures on the tasks in Article 5 of the Government's Decree No. 120/2016/ND-CP dated August 23, 2016. The remaining amount, i.e. 15% of collected fees, must be transferred to state budget according to corresponding chapters and sub-items of the current State Budget Index.

Article 7. Effect

1. This Circular comes into force from June 01, 2022.

2. This Circular supersedes:

a) The Circular No. 305/2016/TT-BTC dated November 15, 2016 of the Minister of Finance.

b) The Circular No. 17/2018/TT-BTC dated February 09, 2018 of the Minister of Finance.

3. Other contents related to the fee collection, transfer, management and use, collection documents, and disclosure of fee collection policies, which are not provided for in this Circular, shall comply with the regulations laid down in the Law on fees and charges; Government's Decree No. 120/2016/ND-CP; Government’s Decree No. 11/2020/ND-CP dated January 20, 2020; Government’s Decree No. 123/2020/ND-CP dated October 19, 2020; Circular No. 303/2016/TT-BTC dated November 15, 2016 and Circular No. 78/2021/TT-BTC dated September 17, 2021 of the Minister of Finance.

4. During the implementation of this Circular, if any documents referred to in this Circular are amended, supplemented or superseded, the newest ones shall apply.
