DECISION

APPROVING THE NATIONAL STRATEGY ON HOUSING DEVELOPMENT 2021 – 2030, WITH A VISION TOWARD 2045

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law on Amendments to the Law on Organization of the Government and the Law on Organization of the Local Government dated November 22, 2019;

Pursuant to the Law on Housing dated November 25, 2014;

Pursuant to the 2021 - 2030 socio-economic development strategy;

At the request of the Minister of the Ministry of Construction.

I. VIEWPOINTS

1. Having an appropriate and secure home is one of the fundamental rights and crucial conditions for the comprehensive development of humans and, concurrently, a decisive factor in the human resources for national development. Housing development is the responsibility of the State, the society, and people.

2. Housing development is one of the important contents of the socio-economic development policy; the State encourages economic compositions of housing development according to the market mechanism to meet the needs of the people and, concurrently, adopt policies to render housing support to social policy beneficiaries, low-income earners, and poor people facing housing difficulties in order to maintain political stability, ensure social security and develop urban, rural areas toward civilization and modernity.

3. Housing development in localities must be in association with the development of residential real estate market, be in line with housing programs or plans in each period and comply with the law on housing, master plans and plans approved by competent agencies to ensure synchronous technical and social infrastructure. To develop housing on the basis of economically using resources, especially land; to intensify the management of house construction.

4. Housing development must ensure the safety and meet the conditions on construction quality, architecture, landscape, convenience, and environment; ensure the capability to respond to climate change, natural disasters, and diseases, and ensure energy conservation, sustainable development, low waste generation in accordance with standards promulgated by competent agencies.

5. Developing diverse types of housing, especially social housing, apartment buildings, houses for rent, houses for workers of industrial zones in order to solve the basic housing requirement of people, especially people in urban areas. Striving to develop housing in rural areas in association with the national target program on new rural construction.

6. Ensuring stable housing for workers and developing houses for workers in association with the responsibility of employers, industrial zone authority, manufacturing area, local government, and trade union organizations; such development shall be in line with the requirement of manufacturing activities and stipulate houses for workers a crucial infrastructure of the industrial zone.

II. TARGETS

- Develop affordable housing for average-income or low-income households and policy beneficiaries.

- Develop sustainable and transparent residential real estate market under the directive and supervision of the State in accordance with the approved master plan for land use, strategies, programs, plans for housing development; limit speculation and land resource dissipation in housing development.

2. Specific targets

a) Housing floor area development

- Strive to reach 27 m2/person for the average floor area in the whole country by 2025, in which: the average floor area in urban areas will reach 28 m2/person and 26 m2/person for rural areas.

- Strive to reach 30 m2/person for the average floor area in the whole country by 2030, in which: the average floor area in urban areas will reach 32 m2/person and 28 m2/person for rural areas.

b) Housing quality improvement

- New housing development must ensure its quality in accordance with the standard and be in association with urban development projects to ensure synchronous technical and social infrastructure, connect transport infrastructure, and digital infrastructure; design to expand the functional and convenient space of the house toward green space development, sustainability, and low waste generation.

- Improve the quality of existing houses through promoting the application of regulations, standards, and approved master plans when renovating or rebuilding separate housing, flats of households, and renovate or rebuild apartment buildings according to synchronous or modern projects.

c) Commercial housing development

- Develop commercial housing according to projects and in association with urban development, housing development programs. Encourage investment in developing modern high-rise apartments that are environmentally friendly and have low waste generation in order to improve the quality of housing, connect and synchronize the infrastructure system.

- Develop diverse types of housing for rent, lease purchase, and sale. The housing product structure must be appropriate, in which increase the proportion of investment in commercial housing with average floor areas and affordable prices through the residential real estate market and incentive policies of the State.

- The State shall have policies on the assurance of housing development resources allocation through the market mechanism in a manner of publicity and transparency.

d) Social housing development

- Promote the development of commercial housing to meet the need of policy beneficiaries who have housing difficulties such as urban low-income earners, workers in industrial zones, officials, officers, soldiers of the People's Armed Force through adjusting and supplementing policies in order to increase the supply combined with solvency support.

- Develop social housing according to a project with positions and scale in association with the area that has many demands for it, or in association with the land fund for social housing development allocated in the approved urban development master plan, housing development plan in order to ensure equality and increase the synchronous infrastructure and other crucial social services.

- Diversify social housing supply through supplementing types of social housing development appropriate with reality; incentive investment policies, land, finance, tax, etc. In which strongly encourage organizations or individuals of any economic composition to participate in developing housing for rent.

- Each beneficiary shall receive a separate and specific policy, ensuring its target, subject, and requirement as well as appropriate incentive policies.

dd) Official residence development

- Fully or promptly meet the needs of official residence for subjects of central authorities or administrative divisions when reassigned in order to ensure a stable, safe, and convenient life for the subjects during their working process.

- Diversify methods of creating an official residence fund through the form of the State direct investment in construction or investment in purchasing, renting commercial housing to use as official residences.

- The utilization, management, and operation of official residence funds shall be effective and economically efficient.

e) House serving relocation development

- Meet the basic needs of house service relocation in accordance with the development principle and housing relocation prescribed in the law on housing.

- Diversify forms of housing relocation through using commercial housing; or using social housing constructed according to projects or land funds to allocate housing relocation. Prioritize relocation at the same location or its vicinity in order to contribute to the social safety of relocation subjects.

- The development of house serving relocation shall be performed in a manner that ensures the benefit of the State, people who are relocated, and enterprises. The allocation of relocation houses shall be performed in a manner that ensures its subject and requirement in accordance with the law on housing. Relocation houses shall be constructed in a manner that ensures the quality according to standards that are appropriate with the needs of people who are relocated.

g) Support of housing according to target programs

- Poor households in rural areas, ethnic minority areas, mountainous areas, or poor households in poor districts[2] that have housing difficulties shall receive housing support (i) from the central budget; (ii) receive increased preferential loan rate as well as additional support from the private investment of localities upon request, and other legal funds; (iii) receive supported houses with increased quality and expanded minimum floor area appropriate with the socio-economic condition of the country.

- Households in areas frequently affected by natural disasters, climate change (storm, flood, landslide, etc.) shall receive preferential loans to build new houses or repair, renovate existing houses to increase their resistance. With regard to dangerous areas, support the infrastructure construction of the relocation area in safe areas using the state budget.

- With regard to students, develop housing for rent in association with the approved master plan, the investment in training facilities construction in order to ensure the living condition is appropriate with the educational environment.

h) Development of houses of households or individuals

- h) Development of houses of households or individuals in rural areas

+ Shall be appropriate with the approved master plan for the construction of rural residential areas; ensure environmental hygiene and connect with the housing technical infrastructure system. The construction, renovation, repair of housing shall be appropriate with the customs combined with the preservation of traditional housing architecture of each region.

+ If a household or individual builds a house in a project, such project shall be appropriate with the detailed master plan for that approved project. With regard to an area that is required to have a construction permit and a design document, comply with the mentioned documents in accordance with the law on construction.

+ If a house of a household or individual is subject to an area that needs preservation of art value, architecture, culture, and history, the construction, repair or renovation of that house shall comply with the law on cultural heritage.

- h) Development of houses of households or individuals in urban areas

+ Shall comply with the technical standard of construction; connect with the technical infrastructure system of the corresponding area; ensure the requirement of hygiene, environment, architecture; and shall not affect nearby buildings.

i) Renovation or reconstruction of apartment building

- Renovation or construction of an apartment building according to a project shall be in accordance with the urban renovation, and appropriate with the construction master plan, master plan, land use plan, housing development plan, and renovation or reconstruction of apartment building plan approved by the competent authority.

- Prioritize the renovation or reconstruction of apartment buildings or apartment areas that are subject to deconstruction in accordance with the law on housing in order to ensure lives, properties, and improve living conditions of people in the mentioned places; striving for the development of a green urban city that is modern, civilized, and sustainable.

- Improve the management role of the State in controlling the investment of renovation, reconstruction of apartment buildings activities.

k) Apartment building management and operation

- Maintain the quality of the building through its management, maintenance, operation, all of which are conducted frequently, periodically, and in accordance with the technical process.

- Improve the service quality and management capability during the process of operating the apartment building in order to improve the utility, living conditions; ensure the safety of people who use and manage the building, especially fire prevention safety.

- Ensure the equality of benefit and agreement of parties on the right to own, use, utilize areas in the apartment building in order to reduce disputes, complaints; and ensure the social security and order at apartment building areas in association with the operation of the local authority.

1. Complete housing institutions and policies

- Complete, amend, or supplement a number of housing development policies including: (i) Commercial housing; (ii) social housing; (iii) official residences; (iv) houses serving relocation; (v) housing according to target programs; (vi) separate housing of households or individuals; (vii) apartment building renovation or reconstruction; (viii) apartment building management and operation.

- Develop policies to encourage developing commercial housing according to projects with average floor areas and prices appropriate with the solvency of subjects according to the market mechanism.

- Research and promulgate, supplement housing standards for new designs, techniques, and construction technologies in order to improve the housing quality in line with the trend of green, sustainable, smart housing development, and digital technology application; concurrently, intensify the inspection of the performance of housing standards application. Develop mechanisms and policies to encourage applying housing standards for existing residential areas of households or individuals in association with the urban renovation.

- Supplement mechanisms, incentive policies, and encouraging policies for organizations or individuals that participate in developing green housing with economic energy consumption and housing with low waste generation and digital technology application.

2. Solutions for the master plan and land fund development

- While making or approving urban master plans, rural residential area construction master plans, industrial zone master plans, allocate land funds in order to develop housing appropriate with the approved master plans, land use plans; and to develop urban projects, housing development projects, social housing development projects, official residences, houses serving relocation, etc.

- While making or approving master plans for projects of commercial housing development and urban development, or industrial zone master plans, allocate land funds for social housing construction.

- While making urban master plans, adjust, revise existing master plans, reconstruct existing residential areas toward population density reduction combined with modern high-rise housing model; and ensure the synchronization of the infrastructure, or make plans for the renovation of existing residential areas.

3. Enhance the capability of housing development according to projects

- Enhance the capability of an investor of a housing development project through supplementing regulations on conditions to be met by investors in order to ensure that the investor has sufficient capability, function, and experience to conduct housing projects; prioritize the investor who has a plan that is highly appreciated for its method of the master plan, architecture, investment in technical infrastructure construction, social infrastructure, the performance of the project, application of the building, and operation and management method.

- Improve efficiency, publicity, and transparency during the process of selecting investors for the projects of urban development, housing development, social housing development, or renovation or reconstruction of apartment building through bidding. Supplement regulations of the criteria or standard framework in a manner of unification and completion on conditions to be met by investors in the bidding documents for investment projects.

- Intensify the supervision and apply sanctions in order to ensure the investors fulfill their approved commitments, duties, and contents during the process of implementing the project.

- Intensify the management after the housing construction; promulgate regulations on management as well as regulations on handover, reception, and maintenance of technical infrastructure or social infrastructure works in housing development projects.

4. Housing development methods according to the national housing development strategy; housing development plans or programs of localities

- Improve the role of the national housing development strategy; housing development programs or plans of localities in managing housing development and adjusting them to ensure the balance between supply and demand for housing. Intensify the managing function of the state for housing of central housing management state authorities and localities.

- Specifically regulate contents in the national housing development strategy; housing development plans or programs such as procedures for approval and program or plan adjustments to ensure the unification of the implementation in localities. Manage the housing development projects section in the 5-year housing development plan as a basis for approving investment policies.

- Ensure the connectivity and synchronization between the mentioned plans and relevant laws, especially the related types of master plans.

a) Fund solutions

- Appropriately allocate funds from the state budget in order to develop housing for subjects of the policies or for the housing target plans.

- Mobilize the private investment funds to develop housing such as enterprise funds, banks, credit organizations, local development investment funds, stocks, bonds, and other legal funds in order to create a stable and long-term financial housing system, and reduce dependence on the state budget.

- Efficiently mobilize foreign funds through international financial mobilization mechanisms such as investment funds, real estate investment trusts, joint venture or joint implementation of housing projects; in order to facilitate foreign investors to participate in developing social housing.

b) Tax solutions

- Continue performing tax incentives related to social development such as the exemption or reduction of value-added tax, enterprise income tax, and other incentives in accordance with the law on tax and the law on housing.

- Adjust or supplement types of tax related to housing in order to adjust the real estate market in accordance with the actual situation; and avoid loss of the state budget.

6. Solutions for the real estate market development

- Research and amend the law on real estate trading in order to complete the trading policies in general and policies for trading, housing trading, housing projects in particular, including existing houses trading, off-the-plan houses trading, transfer of land use rights invested in infrastructure construction for an organization or individual to build their house, transfer the project, or transfer parts of the project, etc.

- Intensify the control over real estate brokerage activities that have housing brokerage activities of organizations or individuals in the following directions: enhance qualification and professional ethics for individuals who practice real estate brokerage (standardize training, examinations, and issue certificates); individuals who practice real estate brokerage shall register and participate in organizations, offices, groups, etc. for management.

- Complete the adjustment policies to stabilize and ensure the stability and health of the real estate market, creating a basis for state authorities to propose and promptly implement methods to stabilize and adjust the real estate and housing market when they are not stable (“hot”, “frozen”).

- Improve the efficiency of state management in terms of real estate and housing trading; improve state management responsibilities in terms of housing and real estate market of ministries, central authorities, and localities; complete the construction, management, and use of the housing and real estate market information system in order to ensure the publicity and transparency; improve the efficiency of inspection, handling, and prevention of violations in the trading of housing and real estate.

7. Solutions for the reform of financial and investment procedures

- Simplify financial procedures in the housing development investment procedures from selecting the investor, allocating lands, investing in the project construction, and issuing the certificate of ownership, etc. Review, reduce, simplify, standardize, and conduct digital transformation of financial procedures in terms of construction for separate housing and housing of households in order to get more participation of the people.

- Complete the law on housing and investment in the direction of unifying and synchronizing regulations of the law on investment, law on bidding, and law on land (including mechanisms and policies for the investors of social housing construction investment project).

8. Other solutions

- Step up the application of science and technology; research and apply designs, techniques, new housing construction technology, and new materials; apply digital technology in order to save costs, reduce the cost of housing construction, concurrently, use the energy effectively and have low waste generation.

- Step up basic research, professional training in housing development and real estate trading.

- Promote the propagation of social housing policies and provide information for the people through many different methods of communication. Develop social housing communication plans in accordance with the directive of the Communist Party and the State; allocate sufficient resources to implement such plans before promulgating new policies in order to gain the agreement of the people. Promote the propagation, mobilization, and guidance for the implementation of new standards.

Article 2. Implementation

1. The Ministry of Construction

a) Assume the prime responsibility for, and cooperate with ministries, central authorities and localities in implementing the national housing development strategy 2021 - 2030, with a vision toward 2045; guide and urge the implementation of local housing development programs; monitor and summarize the results of implementation of this strategy for reporting to the Prime Minister and preliminarily and periodically review the strategy; propose amendments and supplements to the strategy to suit the practical situation in each period;

b) Propose amendments and supplements to urban construction, housing and real estate business laws in conformity with housing development strategies and orientations and the practical situation; research and propose amendments and supplements to technical regulations and standards related to housing development; develop mechanisms and policies and solutions to support each group of social policy beneficiaries facing housing difficulties to improve their homes;

c) Provide directives, guidelines, inspections for housing development programs or plans of provinces, centrally affiliated cities before such plans, programs are approved by the competent authority. Supervise the implementation of the mentioned plans, programs.

d) Assume the prime responsibility for, cooperate with related ministries, central authorities, and localities in developing target programs, plans, projects for housing support for each group of specific subjects according to its authority; assign responsibilities to localities and submit reports to the Prime Minister for consideration and decision.

dd) Assume the prime responsibility for, cooperate with related agencies in conducting basic research, providing training in terms of housing; research and apply designs, techniques, new housing construction technology for housing that has low waste generation and is environmentally friendly, and housing that is climate change adaptive.

b) Assume the prime responsibility for, cooperate with the Ministry of Construction and related ministries, central authorities, and localities in researching, amending, supplementing policies and laws on investment, and relevant laws in order to simplify housing development investment procedures.

3. The Ministry of Finance

a) Research encouraging policies to develop diversified funds for housing development such as real estate investment funds, real estate investment trusts, real estate enterprise bonds, and other long-term financial instruments.

b) Research and propose additional taxes related to the real estate market such as property or residential tax in order to stabilize the market, limit speculation, effectively utilize residential real estate, and ensure the benefit of the State.

c) Provide guidelines for the implementation of incentives related to finance, tax, credit, land use fee exemption, promulgate such guidelines according to its authority; or present to the competent authority regulations on value-added tax exemption, enterprise income tax, personal income tax, and other taxes related to social housing development activities.

4. The Ministry of Natural Resources and Environment

a) Assume the prime responsibility for, cooperate with the Ministry of Construction and related ministries, central authorities, and localities in researching, amending, supplementing policies and laws on land according to the duties and solutions proposed in this Decision.

b) Supplement regulations in order to determine the legal ownership of new residential real estate and legal real estate products with accommodation.

c) Review and complete regulations in the direction of simplifying the financial procedures during the process of assigning land to projects of housing development as per regulation.

a) Direct and operate the credit system to ensure the safety and stability of credit policies in terms of residential real estate.

b) Complete policy mechanisms related to real estate mortgage in order to utilize the ability to mobilize funds for the needs of residential real estate development.

c) Promptly provide guidelines for credit organizations for social housing loans; direct the Bank for Social Policies to implement social housing loan programs in accordance with the Law on Housing and relevant laws.

d) Cooperate with the Ministry of Construction, the Ministry of Finance when these units propose, develop the mechanism to create a long-term financial source for housing development.

6. The Bank for Social Policies

Organize the implementation of preferential loans for beneficiaries of social housing purchase, lease purchase policies, or borrowers who want to construct new houses or renovate existing houses; and borrowers for investment in social housing construction.

7. The Ministry of Justice

Cooperate with ministries, central authorities involved in construction in supplementing regulations in terms of housing and real estate trading; ensure the synchronization, compatible and avoid overlap with other relevant laws in order to develop housing according to the duties and solutions proposed in this Decision; implement the control over financial procedures, procedures of housing investment, and real estate trading.

9. The People’s Committee of provinces, centrally affiliated cities

a) Perform the state management function for housing in their localities through organizing the development of housing development programs, plans, and the controlled development of the residential real estate market.

b) Create master plans, allocate land funds for housing development, especially social housing in their localities in accordance with regulations of the law.

c) Allocate funds from the state budget to invest in social housing construction and provide housing support for social policy beneficiaries in their localities in accordance with regulations of the law.

d) Incorporate housing development targets into local periodical socio-economic development plans; implement and periodically evaluate the performance of housing development tasks in the local socio-economic development plan.

dd) Continue to step up the delegation of powers and financial renovation related to housing development.

e) Encourage the community, social organizations, volunteer organizations or individuals, philanthropists to support the housing renovation for poor people who have housing difficulties.

10. Other organizations

a) Request the Vietnam Fatherland Front and its member organizations to mobilize people to observe and supervise the observance of the housing law; mobilize domestic and overseas organizations and individuals to make contributions and supports to programs on building houses for social policy beneficiaries, low-income earners and poor people facing housing difficulties.

c) The Vietnam General Confederation of Labor shall cooperate with related ministries, central authorities, and agencies in investing in housing construction, healthcare, educational facilities, supermarkets, and commercial, service works, cultural, sport works in industrial zones, manufacturing areas in order to improve housing quality for workers in the mentioned zones, areas.

Article 3. Entry into force

This Decision comes into force as of its date of promulgation.

Ministers, directors of ministerial agencies, directors of Government’s affiliates, chairmen of the People’s Committee of provinces, and centrally affiliated cities shall implement this Decision.
