AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR No. 10/2012/TT-BNNPTNT DATED FEBRUARY 22, 2012 OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT ISSUING THE LIST OF PLANT PROTECTION DRUGS PERMITTED FOR USE, RESTRICTED FOR USE AND BANNED FROM USE IN VIETNAM

MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/ND-CP dated 03 May 2008 01 of the Government regulating functions, duties, powers and organizational structure of Ministry of Agriculture and Rural Development, and Decree No. 75 / 2009/ND-CP dated September 10, 2009 by the Government on amending Article 3 of Decree No. 01/2008/ND-CP dated 03 May 2008 01 of the Government regulating functions, duties, power and organizational structure of Ministry of Agriculture and rural Development;

Pursuant to the Ordinance on Plant Protection and Quarantine dated July 25, 2001;

Pursuant to Circular No. 38/2010/TT-BNNPTNT dated June 20, 2010 of the Ministry of Agriculture and Rural Development regulating the management of plant protection drugs;

Considering the proposal of the Director of Department of Plant Protection;

Minister of Agriculture and Rural Development issues the Circular amending and supplementing some articles of the Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 issuing the list of plant protection drugs permitted for use, restricted for use or banned from use in Vietnam.

1. To modify the name of the organization applying for registration, trade name, way of recording of drug content, registration subject, content of active substances (Annex 1 attached).

2. Official registration: 07 cases (including 01 kind of pesticide, 02 kinds of fungicide, 01 kind of herbicide, 01 kind of growth regulator, 01 kind of anti-termite drug, 01 preservation drug of forest products) to the list of plant protection drugs permitted for use in Vietnam (Annex 2 attached).

3. Additional registration: 315 cases (including 143 kinds of pesticide, 124 kind of fungicide, 31 kinds of herbicide, 09 kinds of growth regulator, 05 kinds of anti-snail drug, 02 kinds of anti-termite drug, 01 synergist to the list of plant protection drugs permitted for use in Vietnam (Appendix 3 attached).

Article 2. The export and import of plant protection drugs in this Circular shall comply with Decree No. 12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Commercial Law concerning the purchase and sale activities of international goods and activities of agent, purchase, sale, processing and transit of goods with foreign countries and Circular No. 88/2011/TT-BNNPTNT dated December 28, 2011 of Ministry of Agriculture and rural Development guiding implementation of Decree No. 12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of Commercial Law concerning the purchase and sale activities of international goods and activities of agent, purchase, sale, processing and transit of goods with foreign countries in the area of agriculture, forestry and fisheries.

Article 3. Director of Department of Plant Protection, Chief of Office of the Ministry, heads of units of the Ministry and other organizations and individuals concerned are liable to implement this Circular.

Article 4. This Circular takes effect as from July 20, 2012. /.
