CIRCULAR

PROMULGATING REGULATION ON ORGANIZATION AND OPERATION OF GENERAL EDUCATION SCHOOLS FOR ATHLETICALLY GIFTED STUDENTS

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Law on Physical Training and Sports dated November 29, 2006; and Law on amendments to the Law on Physical Training and Sports dated June 14, 2018;

Pursuant to the Government’s Decree No. 69/2017/ND-CP dated May 25, 2017 on functions, duties, powers and organizational structure of the Ministry of Education and Training;

At the request of Director General of Physical Education Department;

The Minister of Education and Training hereby promulgates a Circular promulgating regulation on organization and operation of general education schools for athletically gifted students.

Article 1. Promulgated together with this Circular is the regulation on organization and operation of general education schools for athletically gifted students (hereinafter referred to as “schools for the gifted”).

Article 3. Head of Office of the Ministry, Director General of Physical Education Department, heads of relevant affiliates of the Ministry of Education and Training; Chairpersons of People’s Committees of provinces and central-affiliated cities; heads of Departments of Education and Training, Department of Education, Science and Technology of Bac Lieu province and Departments of Culture, Sports and Tourism; Principals of schools for the gifted; and relevant organizations and individuals shall implement this Circular./.

ORGANIZATION AND OPERATION OF SCHOOLS FOR THE GIFTED

Article 1. Scope and regulated entities

1. This Regulation provides for organization and operation of schools for the gifted, including organization and educational activities; duties and powers of managerial public employees, teachers and students; facilities and funding; and relationship between the school, the family and the society.

2. This Regulation is applicable to schools for the gifted providing compulsory education for students from primary to high school level.

Article 2. Position and functions

1. Schools for the gifted are educational institutions of the national educational system and specialized schools for athletically gifted students.

2. Schools for the gifted have the functions of training, fostering and developing athletic talents of students and teaching the national curriculum according to regulations of the primary school statute and lower secondary school, upper secondary school and multi-level school statute promulgated by the Minister of Education and Training.

Article 3. Management decentralization

1. Schools for the gifted affiliated to local governments are under the professional management of Departments of Culture, Sports and Tourism and state management of Departments of Education and Training concerning teaching of the general education curriculum.

2. Schools for the gifted affiliated to ministries are under direct management of ministries and management of Departments of Education and Training of provinces where they are located concerning teaching of the general education curriculum.

1. Managerial public employees and teachers of schools for the gifted are entitled to benefits offered to managerial public employees and teachers of general education schools at the same education level and incentives for teachers and managerial public employees working in specialized schools and areas with extreme socio-economic difficulties as per regulations.

2. Teachers directly in charge of sports in which students are gifted (hereinafter referred to as “gifted sports”) in schools for the gifted are entitled to other incentives as per regulations.

Chapter II

ORGANIZATION AND EDUCATIONAL ACTIVITIES

Article 5. Organization of schools for the gifted

1. Schools for the gifted shall be organized in compliance with regulations of the primary school statute and lower secondary school, upper secondary school and multi-level school statute promulgated by the Minister of Education and Training and the following requirements:

a) The Principal Board shall assign at least 01 school leader to take charge of training in gifted sports and at least 01 school leader to take charge of compulsory education provision.

The school leader in charge of training in gifted sports must be professionally trained in sports;

The school leader in charge of compulsory education provision must be professionally trained in compulsory education as per regulations.

Classes for learning the general education curriculum shall consist of students having the same education level regardless of their ages;

Sport training classes shall consist of students having the same professional level in the sport regardless of their education levels and ages. Each sport training class shall comprise no more than 25 students and each student may join only one sport training class.

Every student shall join both types of classes.

c) There are specialized teams for gifted sports in the schools.

d) There is a medical unit with qualified healthcare workers and medical equipment to ensure healthcare, rehabilitation and first aid during training as per regulations.

e) There is a unit in charge of managing student dormitories.

2. Teachers of gifted sports are qualified for training according to regulations of the sports sector, have a bachelor’s degree in sports/physical training or higher and hold a trainer certificate issued by the competent authority as per regulations.

3. Schools for the gifted may open sport training classes when meeting requirements in terms of training equipment, facilities and teachers as per regulations.

Article 6. Learning plans and curricula of schools for the gifted

2. Learning plans of subjects of compulsory education of schools for the gifted shall be formulated in accordance with the existing general education curriculum of the Ministry of Education and Training and under direct state management of Departments of Education and Training.

3. Departments of Culture, Sports and Tourism shall directly manage and approve gifted sport training plans based on sectorial and local sports developing plans and Vietnam’s high performance sport developing strategy promulgated by the Government.

4. Provide plans for training and participating in sports competitions suitable for student's age to evaluate gifted sport training process and development level of students.

5. Organize diverse educational activities to provide comprehensive education for students.

Article 7. Admission to schools for the gifted

1. Admission plans

a) For schools for the gifted affiliated to local governments: Departments of Culture, Sports and Tourism shall formulate, finalize and propose admission plans and admission quotas with Departments of Education and Training to Chairpersons of provincial People’s Committees for approval.

b) For schools for the gifted affiliated to ministries: their Principals shall formulate and propose admission plans and admission quotas to their supervisory ministries according to regulations.

3. Admission methods and content

a) Knowledge: applicants shall be considered based on their school report books and certificates of completion of education programs applicable to their education levels.

Requirements for primary school applicants shall adhere to existing regulations;

Lower secondary school applicants must have a certificate of completion of primary school education program;

Upper secondary school applicants must have a lower secondary school diploma.

b) Gifted sports: applicants shall take the following entrance examinations:

Examination of physique, components of fitness and basic athletic talents;

Examination of talent, potential and skills for the sports applicants are applying for.

2. During the training process of six months to one year at the maximum, students who fail to meet professional requirements or have no potential for making achievements in the sports that they are training in will be transferred to another general education school in the same locality as per existing regulations.

3. Any student who wishes to transfer to a school for the gifted of another province or city must comply with existing regulations on athlete transfer. If violating any of these regulations, the student must cover all training costs of the years where they receive training in the previous school for the gifted.

a) Transfer of students of schools for the gifted affiliated to local governments must be approved by head of Department of Education and Training and head of Department of Culture, Sports and Tourism as per regulations.

b) Transfer of students of schools for the gifted affiliated to ministries must be approved by supervisory ministries of the schools as per regulations.

Article 9. Assessment, classification, consideration for moving up to next grade and school leaving age for schools for the gifted

1. Assessment, classification, consideration for moving up to next grade and application for universities, colleges and postsecondary schools for students of schools for the gifted shall be carried out in accordance with regulations applicable to students of general education schools.

2. Assessment and classification of athletic talents

a) Regular assessment and classification of athletic talents of students shall be carried out by gifted sport teachers directly in charge of the students.

b) Periodic assessment and classification shall be carried out by gifted sport teachers and an assessment council according to the general plan of the school. The assessment council shall be decided by the Principal of the school.

4. Students of schools for the gifted participating in training or sports competitions for a long period of time overseas or at national sports training centers and unable to take examinations for moving up to next grade or education level or school-leaving examinations are entitled to incentive policies as per regulations.

5. Students of schools for the gifted winning a gold, silver or bronze medal in a national or international sports competition or being athletes of level 1 or higher are entitled to incentive policies for consideration for moving up to next grade or education level, school-leaving examinations and examinations for admission to universities, colleges and postsecondary schools as per regulations.

6. School leaving age for students of schools for the gifted shall be no more than 20 years old.

Chapter III

DUTIES AND POWERS OF MANAGERIAL PUBLIC EMPLOYEES, TEACHERS AND STUDENTS

Article 10. Duties and powers of Principals and Deputy Principals

1. Duties and powers of Principals

a) Fulfill the duties and exercise the powers provided in the primary school statute and lower secondary school, upper secondary school and multi-level school statute promulgated by the Minister of Education and Training.

b) Organize proper management and use of property, facilities and specialized equipment for gifted sports training. Organize management of and direction on promoting capacity of public employees, teachers and students for teaching, training and learning to improve professional training quality and develop athletic talents of students.

a) Fulfill the duties and exercise the powers provided in the primary school statute and lower secondary school, upper secondary school and multi-level school statute promulgated by the Minister of Education and Training.

b) Assist Principals in directing tasks performed to achieve targets set by their schools concerning work areas assigned by Principals and take responsibility before Principals for quality and progress of assigned work.

Article 11. Duties and powers of teachers and staff

1. Teachers and staff of schools for the gifted shall fulfill the duties and exercise the powers provided in the primary school statute and lower secondary school, upper secondary school and multi-level school statute promulgated by the Minister of Education and Training.

2. Gifted sport teachers of schools for the gifted shall exercise the powers and fulfill the duties provided in regulations, the Law on Physical Training and Sports and existing regulations of the sports sector and the following duties:

a) Search and propose enrolment of students with athletic talents or potential to schools for the gifted to the competent authority.

b) Directly train athletically gifted students according to programs and plans of their schools to develop students' athletic talents according to targets.

c) Advise Principals on training content and programs; formulate admission criteria and participate in gifted sports admission. Propose specialized equipment and facilities for sports training and competitions.

d) Assess and classify development of athletic talents of students by semester and academic year. Propose further training of students with potential for athletic talent development and transfer of students without potential for athletic talent development to another school based on professional criteria.

1. Students of schools for the gifted have the duties and powers provided by existing regulations.

2. Students shall complete the general education curriculum according to regulations of the Ministry of Education and Training and gifted sport training objectives and programs of their schools.

3. Students are entitled to student accommodation and use of facilities and equipment for training in their gifted sports; and shall have suitable learning and training schedules to develop their athletic talents in the best way.

5. Students may participate in sports competitions organized by the education and training sector or sports sector according to statutes of the competitions.

6. Students are entitled to incentive policies for examinations for moving up to next grade, moving up to next education level or admission to universities, colleges and postsecondary schools as per regulations.

7. Students are entitled to meal allowances, wages and relevant benefits offered to athletes as per regulations.

FACILITIES AND FUNDING

2. Ensure specialized equipment and facilities for training and competing in sports included in training plans of the schools according to regulations.

3. Provide qualified dormitories and cafeterias for students.

4. Manage and use property in compliance with regulations of the Law on Management and Use of Public Property.

Article 14. Funding

Schools for the gifted shall be funded by:

1. State budget.

2. Sponsorships and assistance from Vietnamese and foreign organizations and individuals per the law and other legal funding sources.

RELATIONSHIP BETWEEN THE SCHOOL, THE FAMILY AND THE SOCIETY

1. The school shall closely cooperate with the family, local government, local mass organizations; business entities and socio-political organizations in providing more material and mental support to achieve targets set out and improve education and training quality for its students.

2. The school shall closely cooperate with the family and social organizations in encouraging people to exercise and play sports for health improvement; encouraging parents to care for and enable their children to develop their talents in sports.

3. The family, local government and social organizations shall facilitate school activities, closely cooperate with the school in nurturing and educating students and enable students to participate in school activities.

Article 16. Representative committees of students’ parents

Representative committees of students’ parents shall be organized in accordance with the statute of representative committee of students’ parents promulgated by the Minister of Education and Training.
